PolySend is a product of sistemica GmbH, Haingarten 5, 61352 Bad Homburg v.d.H., Germany (hereinafter "we", "us", or "PolySend"). By using our services, you agree to these terms.

2. Description of Services

PolySend provides tools for accepting cryptocurrency payments on websites, including a browser extension, mobile application, merchant dashboard, and payment monitoring. PolySend facilitates transactions on the Solana blockchain but does not hold, control, or custody any funds.

3. Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts to use PolySend. By using our services, you confirm that you meet these requirements.

4. Account Responsibilities

You are responsible for maintaining the security of your wallet private keys and account credentials. PolySend cannot recover lost private keys. You are solely responsible for all activity that occurs under your account.

Blockchain transaction fees (gas fees) are paid directly to the Solana network and are not controlled by PolySend. Platform subscription fees are as described on our pricing page and may be changed with 30 days' notice.

7. No Financial Advice

PolySend does not provide financial, investment, tax, or legal advice. Cryptocurrency values are volatile and you may lose some or all of your funds. You are responsible for understanding the risks of cryptocurrency transactions.

8. Limitation of Liability

To the maximum extent permitted by law, PolySend and sistemica GmbH shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the service.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. PolySend may be temporarily unavailable for maintenance, updates, or due to factors beyond our control, including blockchain network issues.

10. Termination

You may stop using PolySend at any time. We may suspend or terminate your access if you violate these terms. Upon termination, your right to use the service ceases immediately. Your wallet data stored locally on your devices remains yours.

11. Governing Law

These terms are governed by the laws of the Federal Republic of Germany. The exclusive place of jurisdiction is Frankfurt am Main, Germany, to the extent legally permissible.

12. Changes

We may modify these terms at any time. Material changes will be communicated via the platform or email. Continued use after changes constitutes acceptance.
